Terms of Service

1. Acceptance of Terms
By accessing or using ShipWave ("the Service"), available at shipwave.dev, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ShipWave ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.
2. Description of Service
ShipWave is an app distribution engine designed for indie developers. The Service provides the following capabilities:
- AI-powered generation of launch posts and promotional content for your applications
- Integration with third-party platforms including Twitter/X, LinkedIn, Reddit, and Product Hunt
- Automated and scheduled publishing of content to connected platforms
- Analytics and engagement tracking for published content
The Service is offered in two tiers: a Free plan with limited functionality (post preview only) and a Pro plan ($24.99/month) with full publishing, scheduling, and analytics capabilities. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. User Accounts
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring that your account information remains accurate and up to date
You must be at least 18 years of age to create an account and use the Service. We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to generate or distribute spam, misleading content, or content that violates any applicable law or regulation
- Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks
- Use the Service to infringe upon the intellectual property rights of any third party
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use automated tools (bots, scrapers, etc.) to access the Service beyond its intended interface
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Violate the terms of service of any third-party platform connected through ShipWave
5. Intellectual Property
The Service, including its original content, features, functionality, design, and underlying technology, is owned by ShipWave and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create or provide through the Service, including the text of posts you compose or edit. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service to you.
AI-generated content produced by the Service is provided for your use. You are solely responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any AI-generated content before publishing.
6. Limitation of Liability
To the maximum extent permitted by applicable law, ShipWave and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Damages resulting from content published through the Service
- Service interruptions, errors, or delays
- Actions taken by third-party platforms (e.g., account suspensions on Twitter/X, LinkedIn, Reddit, or Product Hunt)
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
7. Termination
You may terminate your account at any time by contacting us at support@shipwave.dev or through your account settings. Upon termination:
- Your right to access and use the Service will cease immediately
- We may delete your account data after a reasonable retention period (see our Privacy Policy)
- If you are on a paid plan, you will retain access until the end of your current billing period
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice and without liability to you.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue.
9. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Effective date" at the top of this page and, where appropriate, by sending a notification to the email address associated with your account.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
